The extent of the untested rape kit backlog in New Hampshire is unknown. New Hampshire does not require its law enforcement agencies to count, track, or test rape kits. 

In 2018, New Hampshire enacted a law granting sexual assault survivors the right to notice about the testing status and results of their rape kit. Under the new law, survivors will be informed of policies regarding kit collection and preservation; upon written request, receive written notice no later than 60 days before rape kit disposal; and, upon written request, be granted further preservation of the kit.
