Why did we send the FOIA?
In New York, on the 2019 rape kit inventory report, some law enforcement agencies failed to report their untested kits to the Department of Criminal Justice as required by the statewide inventory law. New York law (SB980) clearly states that each police agency in the state shall report, on a quarterly basis, the number of all the SAKs received, the number submitted to a forensic laboratory, and the number that have not been processed for testing. Based on population, Nassau County is the largest jurisdiction in New York that failed to submit its inventory data to the Department of Criminal Justice; in response, in May 2021, Joyful Heart issued a public records request to Nassau County Sheriff’s Office.

Why Accountability?

Right now, we do not know the full extent of the national rape kit backlog because few states require law enforcement agencies to count, track, or test rape kits. The Accountability Project aims to bring greater transparency and accountability to rape kit testing practices across the country.
